The purpose of the Standard Contractual Terms (AsfF) is to regulate in detail the general elements of the legal relationship between SKC Academy and the customer who requested its services(hereinafter referred to as 'the Customer') for the use of SKC Academy's services, in order to ensure that the specific conditions are essentially laid down in contracts concluded with the Customers (contract of assignment).

SKC Academy's services under contract of assignment contracts include, in particular, but not limited to: education, person certification, examination and all other services which may be necessary in the course of the implementation of the contract, such as information, expertise, transport, etc.

The terms and conditions are part of the contract and can be found on the SKC Academy's website (www.skc.academy). The Customer receives the standard contractual terms and conditions in printed form on request before accepting the contract of payment. The Customer accepts the terms and conditions by signing the contract of contract and/or the General Agreement.

Where there is a discrepancy between the provisions of the contract of contract and the terms and conditions, the provisions of the contract shall prevail.

SKC Academy provides a service on the basis of a written contract of credit if an offer is requested. The Customer is responsible for the correctness, accuracy and timeliness of the information contained in the request for quotation or annexes. SKC Academy prepares its offer on the basis of the information provided to it, given the nature of the service to be ordered and in compliance with the relevant regulations.

Until the conclusion of the contract, SKC Academy's offer may vary in terms of scope, price and time limit, based on consultation with the customer.

Unless prohibited by any other provision, SKC Academy is entitled to prepare its offer in several versions and to offer other optional services in addition to the basic services.

SKC Academy will send the offer or draft contract in writing, by post, fax or e-mail to the Customer for the contact details contained in the request for quotation. The offer is valid in writing only.

The rates for the services included in SKC Academy's offer are independent of whether the proper performance leads to a positive result for the Customer.

SKC Academy sets the duration of the offer in its offer. If SKC Academy does not specify the duration of the offer in its offer, in the case of a distance offer, SKC Academy's tender ingisity exists in view of the nature and complexity of the contract until the Customer has been able to obtain his response to the offer within a reasonable time after the receipt of the offer, and not more than 30 days after the offer has been received by the Customer. If the Customer accepts the offer after the end of the offer period, SKC Academy has the right to modify the contents of the offer or refuse to sign a contract corresponding to the belated offer. The conclusion of the contract of assignment The Customer is free to choose between the variants of the offer or the additional services offered according to his own needs. Upon the return of the accepted, signed tender form or contract within the duration of the contract, the contract of order is concluded as set out therein, for which SKC Academy will send an order confirmation to the Customer.

The conclusion of the contract may be done in a different way, provided that SKC Academy is obliged to provide a service solely on the basis of a written contract on the basis of a written contract on the basis of a paper contract or a written offer and a paper-based order confirmation issued on the basis of its written acceptance on paper.

If the customer removes the obstacle to the performance of the service within the time limit set in the tender, SKC Academy will continue the procedure. In this case, the deadline for its performance will be extended in accordance with the current load of SKC Academy. If the original terms and conditions are to be modified (e.g. if the test sample has been modified in its design), the tests may only be carried out after the contract has been amended.

In the event of a interruption in the performance of the service, except in the case referred to in the preceding paragraph, the customer shall declare in writing that the claim is maintained within 8 days. In the event of non-declaration or no declaration, the contract will be terminated and the service will be closed and invoiced by SKC Academy at the level obtained. If the fee between the pre-transferred and the final invoice differs for any reason, the difference shall be transferred by the contracting party liable to pay within 8 days.

Performance under the contract shall take place in accordance with the generally recognised rules of the activity in question and taking into account the rules applicable at the time of the execution of the order, unless otherwise agreed in writing. Proper performance as provided for in this paragraph shall be deemed to be performance under contract even if it has resulted in an unfavourable result for the Customer. If the relevant requirements change during the performance of the service, the terms and conditions may be modified. The period of performance specified in the contract is determined on the basis of the information provided by the Customer. Delivery deadlines are mandatory for SKC ACADEMY only if they have been expressly and in writing certified by SKC Academy. SKC Academy will only be liable for compensation for derogating from the time limit for performance if the Customer has expressly indicated its interest in meeting the time limit no later than the date of the contract. The Customer's delay in fulfilling its own obligations excludes the simultaneous delay of SKC Academy. [/vc_column_text] [vc_empty_space height="15px"] [vc_column_text] 5. Rights and obligations of the Parties

The Customer and third parties acting on his behalf are obliged to cooperate with SKC Academy in order to perform the service.

The Customer is obliged to carry out the activities necessary for the performance of the performance on his own part, by his assistants or by the contributor third party on a timely basis and free of charge.

The customer is obliged to provide the necessary documentation, test samples, information, communication channels, excipients, auxiliary forces, etc. free of charge. The Customer's cooperation must always comply with applicable legal requirements, standards, safety regulations and accident protection regulations.

The Customer shall bear all the additional costs that cause the work to be delayed or repeated due to:

Even if skc academy has a fixed or capped price, it is entitled to charge the additional input, after prior consultation with the Customer and the itemised justification of the additional expenses, which are necessary and justified.

SKC Academy acts according to the instructions of the customer, but the instructions must not extend to the organisation of the work or make the performance more prenatal. If the customer gives an inappropriate or unprofessional instruction, skc academy experts must warn you. However, if the customer maintains his instructions despite the warning, SKC Academy may withdraw from the contract.

If the service is to be carried out at a place designated by the Customer, the customer is obliged to make the place of performance available to SKC Academy in a suitable condition. SKC Academy may refuse to start work until the customer has fulfilled this obligation. If the customer fails to comply with the obligation within the appropriate time limit set by SKC Academy. SKC Academy may withdraw from the contract and be entitled to grief money and claim damages. The amount of the grief money is set out in section 11 of this GTC. All copyrights and co-copyrights derived from skc academy's opinions and materials shall remain the property of SKC Academy. The Customer should use the opinions and materials prepared in the framework of the mandate only for the purpose for which they were prepared in accordance with the agreement. SKC Academy's complete reporting of the performance of the service and the acceptance by the Customer by signing the "Certificate of Performance" or – sending the documents of the service performed (diploma, certificate, etc.) to the customer in person, by registered letter, fax or email. The certificate of performance must be sent to SKC Academy without delay and at the latest within 8 days.

If the Customer does not acknowledge the performance, he must notify his objections and reasons in writing immediately after the completion of the documents or training, and within a maximum of 8 days. In the event of proper performance, the Customer shall not object to the fact that he has resulted in an unfavourable result for the performance.

If the Customer does not make a written objection, SKC Academy will recognize the performance after 8 days. If the Customer accepts the performance knowingly of the breach of contract, he may stipulate in writing that he reserves the right to pursue his claims arising out of the breach. In the event of a written objection, the Parties shall endeavour to reach mutual agreement. [/vc_column_text] [vc_empty_space height="15px"] [vc_column_text] 9. Terms of payment

The order and other fees specified in the contract of assignment shall be settled against an invoice, unless otherwise specified in the contract of assignment. The fee included in the contract of payment is due regardless of whether the proper performance of SKC Academy has resulted in a positive result for the Customer.

SKC Academy shall be entitled to issue the invoice in possession of the certificate of performance or if the performance is deemed to be recognised in accordance with point 8 of this GTC. Set-off against the amount entered in the invoice shall be subject to written agreement only. The Customer is entitled to lodge objections to the invoice within 8 days of receipt of the invoice.

If SKC Academy undertakes to provide services to a customer against whom it has an overdue claim and is permitted by the nature of the service, SKC Academy shall be entitled to provide the service in instalments. The customer may withhold the performance parts thus prepared until the Customer has settled his debt to SKC Academy or pays the consideration for the works already transferred by SKC Academy.

If the Customer provided the certificate of performance to SKC Academy, he did not object to the performance, but did not comply with his payment obligation within 30 days of the due date, SKC Academy shall be liens for the guarantee of the fee on the assets of the customer which have been acquired by the contract of payment. If the Customer has provided false information or is in a situation significantly different from the state of the contract at the time of performance, SKC Academy may, on the basis of the actual data, adjust its expense requirement and claim reimbursement of its expenses or, to that end, the modification of the contract. SKC Academy is solely responsible for its services under the written agreement.

SKC Academy Customer shall be liable for the accuracy of its services, data and personal materials, data and other statements by its agents and the resulting damages only if the data or statements have been approved in writing by the SKC Academy Examination Centre.

The limitation period of the claim for damages is governed by the CPC. and the relevant legislation.

SKC Academy reserves the right to involve an external authorised staff member(s) in the performance of its obligations under the contract of assignment, who shall be entrusted with the same duties as the direct staff of SKC Academy and for whom SKC Academy is liable as if the work had been carried out by itself.

The contract of assignment shall terminate if terminated by mutual agreement between the parties, if, under the basis of this GTC, the contract of assignment or the law, any of the parties is entitled to withdraw, with withdrawal, with the termination of either party by any party, with the termination of either party without a successor, the death of the natural person Customer, with the loss of the natural person's capacity to act, the order becomes unreasonable or, if the contract is for a fixed period, at the end of a fixed period of time, the contract is terminated. , and if a party is ordered to file bankruptcy or winding-up proceedings against one of the parties.

The Customer cannot exercise the right of withdrawal based on the contract of assignment if he is unable to return the service received in view of the nature of the service provided by SKC Academy. The Customer may terminate the contract of contract at any time with immediate effect in writing, but must justify the termination. In this case, the contract of assignment shall end on the date on which SKC Academy becomes aware of the termination. SKC Academy will be entitled to monetary consideration for the services already provided and, if the termination is not due to skc academy's reasonable grounds, a pro rata of 10% of the fee which was not foregone by the termination of the Customer. In the event of a serious breach of the contract, SKC Academy is entitled to terminate the contract in writing with immediate effect, but it is obliged to give reasons for termination. The customer has the right to object to the termination of the contract or to clarify the information indicated as a reason for termination within 15 days of the date of termination. Even in the event of immediate termination of SKC Academy, it is entitled to monetary consideration for services already provided and to a amount of sorrow equivalent to 10% of the compensation for the failed performance. However, if the order has been terminated for no good reason, it shall reimburse the damage caused.

In the event of termination of the contract for other reasons, the parties shall be obliged to account for each other, under which SKC Academy shall be entitled to an amount commensurate with the performance of the contract. Modification of the service indicated in the contract or as part of the order confirmation or additional use of the services requires a written agreement in all cases. SKC Academy may initiate a contract change if changes occur in the terms of the contract of assignment that substantially alter the cost of the service provided. If the Customer rejects the increase in the amount of expenditure justified, justified and necessary and the modification of the contract without good reason, SKC Academy shall be entitled to refuse the next phase of the service. The resulting disadvantages are borne by the Customer.

The SKC Academy shall be entitled to initiate an amendment to the Contract where changes in the international standards on which its activities are based and/or in the regulation of accreditation bodies and organisations occur which affect the subject matter of the contracts.
